Chattanooga Uncontested Divorce Lawyer

Going through a divorce is a difficult process. It affects your future, your family and your finances. Because it is so emotional, you want to make the process as painless as possible. If you and your spouse can agree on all aspects of the divorce, you may be able to proceed with an uncontested divorce.

At the Law Office of Rebecca Garren Parker in Chattanooga, we work with a diverse clientele throughout southeast Tennessee and north Georgia to find solutions for family law matters. If you are looking for an uncomplicated procedure for divorce, contact a Chattanooga uncontested divorce attorney for more information on how to proceed with a relatively easy divorce.

Please note: You should not have to pay more than $750.00 for an uncontested divorce (not including court costs, which vary by county).

How Does an Uncontested Divorce Work?

There are two basic types of divorces — uncontested and contested. In an uncontested divorce, one or both spouses meet with the attorney, who will draft the parties' agreement. Although the attorney may meet with both parties, it is not ethical to represent both parties in the divorce. Therefore, only one party can be the attorney's client.

Once the agreement is signed and filed with the court, you will enter into a waiting period. The waiting period is 60 days if you don't have minor children and 90 days if you do. After the waiting period, the attorney's staff will schedule the court date and inform you by mail.

Your Spouse Wants You to Sign Uncontested Divorce Papers

If your spouse presents you with uncontested divorce papers do not sign them until you have spoken with an experienced attorney. Legal documents are binding, which means that once you sign, there is no way to start over — you are bound by those terms. For that reason, it is essential that an attorney reviews your divorce documents prior to signing. Our knowledgeable attorney will review your divorce papers to ensure that:

  • You understand the implications of the documents
  • Your rights are protected
  • Child support and alimony are calculated properly
  • Property division is fair and accurate
  • Debts have been apportioned equitably
