How Does an Uncontested Divorce Work?
There are two basic types of divorces — uncontested and contested. In an uncontested divorce, one or both spouses meet with the attorney, who will draft the parties' agreement. Although the attorney may meet with both parties, it is not ethical to represent both parties in the divorce. Therefore, only one party can be the attorney's client.
Once the agreement is signed and filed with the court, you will enter into a waiting period. The waiting period is 60 days if you don't have minor children and 90 days if you do. After the waiting period, the attorney's staff will schedule the court date and inform you by mail.
