Understanding Parenting Terms (Custody)

In Tennessee the term "custody" has been replaced with some new terms, including:

  • Shared parenting: With only a few exceptions, you and your spouse will share parenting of your children under Tennessee law.
  • Primary residential parent: The parent with whom the children live more than 50 percent of the time is the primary residential parent.
  • Alternate residential parent: The parent with whom the children live less than 50 percent of the time.
  • Parenting time: What we used to call "visitation" is now "parenting time." Finally, someone realized that parents do not "visit" with their children; rather, they parent them. You and your spouse, working together, can be creative in establishing a parenting schedule that will work for you if you have an uncontested divorce.

Establishing a Residential Parent and Parenting Time

One of the biggest concerns we hear from clients is about parenting time. You are likely concerned with how the court will apportion the parenting of the children. One of the primary standards that the court looks to in determining parenting time is "what is in the best interests of the children?" While it may be your goal to spend as much time with your child as possible it is important to realize that neither party will be able to parent the children all the time.
